Terms of Service

By downloading, installing, or using the NeuroSet mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

You must be at least 13 years old to use NeuroSet. By using the App, you represent that you are at least 13 years of age.

NeuroSet is a wellness companion app designed to support brain retraining and neuroplasticity practices. The App provides:

• Structured practice sessions with guided exercises
• Quick interrupt tools for in-the-moment support
• Progress tracking and insights
• Symptom and trigger logging
• Breathing and movement exercises

NeuroSet is a wellness companion app and is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition.

The content provided in the App — including exercises, scripts, breathing techniques, and educational materials — is for informational and general wellness purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

ALWAYS consult your physician, therapist, or other qualified healthcare provider before starting any new health or wellness regimen, particularly if you:

• Have a medical condition
• Are pregnant or nursing
• Are taking medications
• Have a history of mental health conditions
• Are experiencing severe or worsening symptoms

Use of NeuroSet does NOT create a doctor-patient, therapist-patient, or any other healthcare relationship between you and NeuroSet, or any affiliated parties.

Do not delay, disregard, or discontinue medical advice or treatment from qualified healthcare professionals based on content from this App. If you are experiencing a medical emergency, call emergency services immediately.

The effectiveness of brain retraining practices varies between individuals. We make no guarantees regarding specific health outcomes or results from using the App.

By using NeuroSet, you agree to:

• Provide accurate information when setting up your profile
• Use the App for its intended wellness and personal development purposes
• Not use the App as a replacement for professional medical care
• Comply with all applicable laws and regulations
• Not attempt to reverse-engineer, decompile, or modify the App
• Not use the App to harm yourself or others

NeuroSet offers a free tier with the following limitations:

• 1 scheduled session per day
• 1 quick interrupt per day
• 7 days of practice history

The Pro subscription removes all limitations and provides full access to all features. Pro subscription is available as:

• Monthly subscription
• Yearly subscription (discounted)

Both options include a 7-day free trial for new subscribers.

All payments are processed through Apple via the App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

You can cancel your subscription at any time through your Apple ID account settings:

1. Go to Settings on your device
2. Tap your name, then Subscriptions
3. Select NeuroSet and tap Cancel Subscription

Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the period ends.

Refund requests are handled by Apple according to their refund policies. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com.

All content in NeuroSet — including but not limited to text, scripts, graphics, logos, icons, images, audio, and software — is the property of James Callaghan (ABN 71 422 008 130) or our licensors and is protected by copyright and other intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from the App without our prior written consent.

Any content you create within the App (such as custom goals and preferences) remains your property. By using the App, you grant us no rights to your personal content beyond what is necessary to provide the service.

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without restriction or compensation to you.

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties regarding specific health outcomes or results

To the maximum extent permitted by applicable law, in no event shall NeuroSet, or any affiliated parties be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages arising from your use of or inability to use the App
• Any damages arising from any health decisions or actions taken based on App content

To the maximum extent permitted by applicable law, our total liability for any claims arising from or related to the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim, or AUD $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.

You agree to indemnify, defend, and hold harmless NeuroSet, and any affiliated parties, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any health decisions you make based on App content

You may stop using the App at any time by uninstalling it from your device. If you have an active subscription, you should cancel it through your Apple ID settings to avoid future charges.

We may suspend or terminate your access to the App at any time, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or third parties
• Is fraudulent or illegal

Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to: Medical Disclaimer, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles.

You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for any disputes arising out of or relating to these Terms or your use of the App.

Before initiating any formal legal proceedings, you agree to first contact us at support@neuroset.app to attempt to resolve the dispute informally.

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of these Terms
• For material changes, we may notify you via the App or other means
• Your continued use of the App after changes constitutes acceptance of the modified Terms

If you do not agree to the modified Terms, you should stop using the App and cancel any active subscription.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us.
